In addition to offer a Property Rights Verification Service on behalf of the applicant, Right My Property also acting as the facilitating service provider as a platform for the individual can upload their property details true to their knowledge and the same can be accessed and assessed by the prospective buyer.

Using our Services does not give you any right or ownership of any intellectual property rights in our Services or the content you access. Right My Property shall be indemnified for any fraudulent activities committed by the applicant or third party who is interested in the property or any financial liability incurred by Right My Property for violation of the terms and conditions by the applicant from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement.

Our Services display contents that may not belong to Right My Property. This content is the sole responsibility of the entity that makes it available. Right My Property does not review the third party advertisements or content except for minimum legal compliance. Any act done by the applicant/seller/buyer acting on the contents on our website does not hold us liable to it and are done at the sole discretion and responsibility of the applicant (seller/buyer/developer).

REPRESENTATION BY THE APPLICANT

To access the service provided by Right My Property, you must create an Account by completing the registration process.

By registering you represent that:

You are a major and that if you are registering on behalf of a person or entity, you are authorized to register for the Service;

You agree that you may be charged a nominal fee for registering on the website and to access the services provided by it.

The information which is provided by you if true and that you have not misrepresented any information.

You undertake that the title of the property listed is of clean title and that Right My Property shall not be liable for any misrepresentations made in this regard.

You undertake that the documents provided by you for verifying title is genuine and is not fabricated.

You also agree and acknowledge that Right My Property is merely a facilitating platform and shall not be responsible for any false information provided by the seller or any issues financial or legal arising out of the sale of the property.

Any such liability, legal or otherwise incurring to Right My Property shall be indemnified by you at actual cost along with any additional costs therein.

In the event that you are registering and listing the property on behalf of a third person, relevant power of Attorney and other additional documents like written consent from the rightful owner shall be provided by you at the time of user registration and at all times as deemed fit by the Right My Property during the process of sale.

You agree that pictures, location and orientation of the house, floor plans, water availability as provided by the Seller shall be shared to the Buyers.

You acknowledge that certain information like phone number and name shall be shared with third parties for performing physical visits or acquiring Revenue records and the same shall be done so within reasonable limits of the scope of this Agreement.

You agree that you shall notify Right My Property at the earliest instance possible of any possible breach of the account data or unauthorized access. To protect such information, you are advised to change the password from time to time and Right My Property shall not be held responsible for any mischief arising due to the carelessness of the seller or any data breach from your side.

You undertake to use the website only for the purposes intended for and shall not commit any act that jeopardizes the information provided by any other user.

You undertake not to put up any listing that can be construed as harassment, religious, racial hatred, obscenity, or of any other inconvenience of any nature.

You agree that in the event of violation of any of the terms mentioned hereunder, Right My Property reserves the right to suspend or deactivate your account and you forfeit the payment made towards any subscription plans.

You shall not post any deep linking or provide access to any content that is not expressly provided by Right My Property and Right My Property reserves the right to take down such violations.

You not to copy, modify, reverse engineer, decompile, disassemble, create derivative works of the website nor attempt to locate or obtain its source code.

Right My Property shall not be liable for any damage caused by the user’s violation of the terms and conditions. Right My Property acts only as a platform between buyers and sellers and is not directly involved in any of the transactions between them and merely facilitates the process.

Property Rights Verification Service

You expressly undertake that the property listed by you on the Right My Property website is in actual possession of the owner and you possess the relevant authorization to list the same.

In the event the prospective buyer requests for Property Rights Verification Service by Right My Property, you undertake to provide valid title documents, Registration papers, Tax Payment receipts for verification upon request.

Further, you undertake to provide access to Right My Property and prospective buyers to inspect/survey the property at reasonable hours.

You undertake to provide Right My Property and its affiliates consent/authorization to make necessary copies of Revenue Records for application to get Certified Copies of the same and provide information on any known encumbrances in the property.

You expressly agree and undertake that Right My Property at any time can suspend or terminate your account and refuse any and all current or further use of the if it determined or have reason to believe that any information provided by you is untrue, inaccurate, forged or fabricated.

Right My Property shall not proceed with Property Rights Verification Service in the event that the Owner is not in possession or permission to survey the property is not given. The applicant shall indemnify Right My Property in the event of any loss borne by them due to non performance of Property Rights Verification Service for the buyer.

REASON FOR COLLECTION OF INFORMATION

Right My Property is involved in rendering services relating to real estate and provides a platform for the Sellers to put up their property for sale and the Buyers to have easy access to the same and at an additional cost, have the Property Rights Verification Service done. The site may track the IP address of a user’s computer and save certain information on their system in the form of cookies. A user has the option to accept or decline the cookies by modifying it on their browser.

The information from users is collected for the following reasons:

1. Contact Number (One Time Password) to login securely, to deliver a customized experience and to maintain user sessions.
2. Age (To ensure the Seller is of legal age to enter into such contract or put the Property up for sale)
3. Country (To enhance the user experience by offering relevant project information based on their geography) City (To enhance the user experience by offering relevant project information based on their geography)
4. To provide updates on the property that suits the users need
5. To suggest buyers according to the geographical location of the property mentioned by the Seller
6. To provide the user information and details that is required by them for Verification / Buying / Selling properties.

INFORMATION TO THIRD PARTY SERVICES

Right My Property permits third party websites to collect cookies and other data as required under their website and the applicant agrees to be bound by the terms and conditions of the third party websites and Right My Property shall not be liable to the Applicant for any such information collected and is outside the scope of this Agreement. Such consent extends to any third party advertisements on the website, tailored to the user’s need. Right My Property is not liable for any such information provided or collected and has no say in any of such advertisements and are being provided on an as is basis. Right My Property is not responsible for any purchases made by you through third party services and no refunds shall be initiated in respect of the same.

CONFIDENTIALITY AND CUSTOMER PERSONAL DATA

You agree that Seller information or any other information relating to use of the services may contain confidential and personal information. Right My Property shall collect personal information such as PAN Card, Aadhaar Card, Bank account details, credit card debit card details and such other personal information.

You agree and undertake that all the Confidential or personal Information will remain the sole property of Right My Property. You agree that these shall remain with Right My Property even after termination of your account.

PAYMENTS

You represent and warrant that if you are availing/ subscribe anything from www.rightmyproperty.com, any credit information you supply is true and complete, charges incurred by you will be honored by your credit card company, and you will pay the charges incurred by you at the posted prices, including any applicable taxes. All purchases made/transactions for the services shall be in Indian Rupees unless otherwise specifically stated.

While the initial browsing of the services by user is free of cost, users have to make advance payment for getting a subscribed account as and when such a service is available with prior intimation. Such payment once made shall be non refundable, unless such amount was wrongfully debited from the User’s account or the property in issue does not fall under the package offered by Right My Property.

In the event that the applicant listing the property is not the title or power holder of the property, such account shall be suspended and the amount paid towards the same shall be forfeited.

CANCELLATION AND REFUND POLICY

1. Any request for cancellations of orders placed for the services shall not be entertained.
2. If by mistake or error on the server or processing, we get payment twice or more than once for the same order, we will refund the amount, received in excess. Where the payment has been made through Credit Card / Debit Card, refund shall be made through the same Credit Card / Debit Card by which you have made the payment. Otherwise, refund shall be made through account payee Cheque.

GENERAL TERMS AND CONDITIONS

You agree, in the event of any dispute arising in relation to these terms and conditions or any dispute arising in relation to the website or the services provided by the Right My Property Private Limited whether in contract or tort or otherwise to submit to the jurisdiction of the Courts of Hyderabad, Telangana State, India for the resolution of all such disputes.

ARBITRATION
